Why Da Vinci Medical Charges Sales Tax
In 2018, the U.S. Supreme Court ruled in South Dakota v. Wayfair, Inc. that states can require businesses to collect sales tax once they cross certain sales or transaction thresholds - even without a physical presence in that state. Because Da Vinci Medical has grown nationwide, we are legally obligated to collect and remit sales tax in the states where we’ve established “economic nexus.” Some of our competitors may not have reached those thresholds yet, so they don’t charge tax in certain states.
What This Means for You
Whether or not a seller collects sales tax, state law requires the buyer to pay it. If a purchase is made without sales tax, the buyer is obligated to report and pay the equivalent use tax on their business or personal tax return. Use tax is simply the counterpart to sales tax, ensuring that the correct amount is paid to your state.
